Federal Hemp Legality and Statutory Compliance Notice
Pursuant to the Agriculture Improvement Act of 2018, Public Law 115-334, § 10113, 132 Stat. 4490, 4908–4911 (2018) (commonly referred to as the “2018 Farm Bill”), the term “hemp” is defined under 7 U.S.C. § 1639o(1) as:
“the plant Cannabis sativa L. and any part of that plant, including the seeds thereof and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a delta-9 tetrahydrocannabinol concentration of not more than 0.3 percent on a dry weight basis.”
In accordance with this definition, products containing no more than 0.3% delta-9 tetrahydrocannabinol (THC) on a dry weight basis qualify as hemp under U.S. federal law.
Further, the 2018 Farm Bill expressly amended the Controlled Substances Act (CSA) to exclude hemp from the definition of marijuana. See 21 U.S.C. § 802(16)(B), which provides that:
“The term ‘marijuana’ does not include hemp, as defined in section 1639o of title 7.”
As a result of these amendments, hemp and hemp-derived products that meet the statutory THC threshold are not classified as controlled substances under federal law.
Accordingly, products formulated and verified to contain less than 0.3% delta-9 THC by dry weight are considered lawful hemp products under United States federal law, subject to compliance with all applicable federal, state, and local regulations.
